1. Acceptance of terms

Welcome to TruckInsurePro. These Terms of Service ("Terms") govern your use of the TruckInsurePro website (the "Service"), operated by Blurbpoint Media Inc. ("we," "our," or "us"). By accessing, browsing, or submitting information through the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please do not use the Service.

2. Description of service

TruckInsurePro is a free, online marketing and lead generation service that connects commercial auto insurance shoppers with licensed insurance agencies, brokers, and carriers ("Insurance Partners"). When you submit a quote request, we share the information you provide with one or more Insurance Partners in our network who may then contact you to offer a commercial auto insurance quote.

You must be at least 18 years old and a legal resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and that all information you provide is true, accurate, current, and complete.

5. Accurate information

You agree to provide accurate, current, and complete information when requesting a quote. Providing false, misleading, or inaccurate information may result in denial of coverage by Insurance Partners, rescission of any policy issued, or termination of your access to the Service.

6. User conduct

When using the Service, you agree not to:

• Submit information that is false, misleading, or belongs to another person without authorization;
• Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law;
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
• Use any automated system (including bots, scrapers, or crawlers) to access the Service except as permitted by our robots.txt file;
• Interfere with or disrupt the Service or servers or networks connected to the Service;
• Upload or transmit viruses, malware, or other harmful code;
• Harvest or collect information about other users of the Service;
• Impersonate any person or entity or misrepresent your affiliation with a person or entity.

All content on the Service, including text, graphics, logos, images, software, and design, is owned by or licensed to Blurbpoint Media Inc. and is protected by U.S. and international copyright, trademark, and other intellectual property laws. "TruckInsurePro" and our logo are trademarks of Blurbpoint Media Inc. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that:

• The Service will meet your requirements or be uninterrupted, timely, secure, or error-free;
• Any information you receive from Insurance Partners will be accurate, complete, or reliable;
• The quality of any quote, policy, or service obtained through the Service will meet your expectations;
• Any errors in the Service will be corrected.

Savings estimates displayed on our website are based on self-reported data from surveyed consumers and are not a guarantee of actual savings. Your actual rates will depend on many factors, including driving history, vehicle type, coverage selections, state, and carrier underwriting guidelines.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Blurbpoint Media Inc., its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, or loss of goodwill — arising out of or related to your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to the Service will not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Blurbpoint Media Inc. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another; or (d) any inaccurate or misleading information you submit.

11. Dispute resolution and arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring a claim in small claims court if eligible.

Class action waiver: You agree to resolve disputes with us only on an individual basis. You may not bring a claim as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Opt-out right: You may opt out of this arbitration provision by sending written notice to the email address in Section 14 within 30 days of first accepting these Terms.

12. Governing law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Rutherford County, Tennessee.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any change constitutes acceptance of the updated Terms.
